Nevada Prosecutors Charge Two More Noncitizens With Voting in 2024; Texas Jury Convicts Indian National

Federal prosecutors in Nevada on Wednesday charged two more lawful permanent residents with voting in the 2024 federal election, and a federal jury in Texas a day earlier convicted an Indian national of voting and of falsely claiming U.S. citizenship to register, according to Justice Department releases.

The two Nevada cases, announced in Las Vegas, bring to three the number of noncitizen voting cases the U.S. Attorney's Office for the District of Nevada has announced since Oct. 23, by The Digital Free Press's count of the office's releases. The Texas verdict, returned Oct. 27 in Fort Worth, is a conviction after trial rather than a new charge.

What the Nevada Noncitizen Voting Charges Allege

According to the office, prosecutors filed two separate criminal informations. One alleges that Moneir Elzobier Ali Yousif, who is from Sudan and is a lawful permanent resident, voted on or about Oct. 29, 2024, in an election that included races for president, vice president, U.S. Senate and U.S. House. The other alleges that Khalida Safi, who is from Afghanistan and is also a lawful permanent resident, voted on or about Nov. 5, 2024, Election Day, in the same election.

Each is charged with one count of voting by an alien, which carries up to one year in prison and a fine of up to $100,000. The office said an initial appearance date had not been scheduled. The FBI and Homeland Security Investigations investigated.

"As these cases show, the public and political narrative that Nevada's elections are not fraught with fraud is categorically false," First Assistant U.S. Attorney Sigal Chattah said in the release. The release does not say how the two were identified or whether their ballots were counted.

On Oct. 23, the same office charged Jullie Ann Sumalinog Moore with voting by an alien, alleging she voted on or about Nov. 2, 2024. A Justice Department release on Oct. 26 that tallied charges against 48 noncitizens nationwide listed one Nevada defendant. Yousif and Safi were charged after that tally.

An information is an allegation, and both defendants are presumed innocent unless proven guilty in court.

The Texas Verdict

In Fort Worth, a federal jury convicted Khalwinder Singh Bhengura, a citizen of India, of voting by an alien in a federal election and of making a false claim of U.S. citizenship to register to vote, the U.S. Attorney's Office for the Northern District of Texas said. The jury returned its verdict Oct. 27 after a two-day trial before U.S. District Judge Mark T. Pittman.

According to the evidence presented at trial, as described by the office, Bhengura became a lawful permanent resident on June 29, 2022, and has never applied for citizenship. On Aug. 1, 2024, he applied for a Texas driver's license in Tarrant County and checked boxes stating that he was a U.S. citizen and wanted to register to vote, and he was registered on the basis of that application. He voted in person on Nov. 5, 2024, at the East Library and Recreation Center in Arlington, the office said.

Sentencing is set for Feb. 11, 2027. The false citizenship claim carries up to five years in prison and a fine of up to $250,000, and the voting count carries up to one year, according to the release. The office said he could also face removal from the United States after serving any sentence.

"Every unlawful vote undermines the voices of eligible citizens," U.S. Attorney Ryan Raybould said. HSI Dallas investigated, with help from the Election Integrity Unit of the Texas Attorney General's Office and the Tarrant County District Attorney's Office.

The Nevada and Texas cases were announced six days before the Nov. 3 general election.
